JS Tutoring Terms & Conditions

The terms below form an agreement between J & S Consulting Ltd trading as JS Tutoring (us, we, our, the company, Sharan Spall / Jatinder Spall) and the applicant, usually the parent/guardian (you, your).

 

1.General

1.1 JS Tutoring will provide such material as necessary to provide the service agreed on.

 

1.2 The Structure/Content of any course provided is subject to change at the discretion of JS Tutoring

 

1.3 Materials (worksheets, videos etc) provided by JS Tutoring are for the sole use of the student enrolled on the course. Sharing/copying materials is strictly prohibited.

 

2.Fees and Payments: (all fees are inclusive of VAT where applicable)

 

2.1 Course payments must be made online at the time of enrolling.

 

2.2 Late-joiners course fee will be the same fee. This is because backdated Course material will be made fully available.

 

2.3 There are no refunds/reduction in fees for late enrolment.

 

3.Early Termination:

 

There is no early termination. No refunds will be made if you choose to not complete any course.

 

4.Communication:

 

4.1 JS Tutoring will use email and Facebook Messenger as our primary methods of communication, please use these channels when communicating to us in writing.

 

4.2 By signing the application form and providing details of your email and phone number you are giving permission for JS Tutoring to contact you as described in this Clause 4, unless you clearly inform us on writing otherwise at our main email address info@js-tutoring.com

 

5.Application to Secondary Schools:

 

It is the responsibility of the parent to contact secondary schools for the application procedures and catchment criteria. JS Tutoring does NOT provide advice or guidance on how to apply to secondary schools.

 

6.Limitation of Liability:

 

6.1 JS Tutoring are not liable for any loss or damage that may come from using our website or services. This includes:

 

(a) any direct, indirect or consequential losses;

 

(b) any loss or damage caused by civil wrongs (‘tort’, including negligence),    breach of contract or otherwise;

 

(c) the use of www.js-tutoring.comand any websites that are linked to or from it; and

 

(d) the inability to use www.js-tutoring.comand any websites that are linked to or from it.

 

6.2 This applies if the loss or damage was foreseeable, arose in the normal course of things or you advised us that it might happen. This includes (but is not limited to) the loss of your:

 

(a) income or revenue;

 

(b) salary, benefits or other payments;

 

(c) business;

 

(d) profits or contracts;

 

(e) anticipated savings;

 

(f) data;

 

(g) goodwill or reputation; and

 

(h) tangible property/intangible property.

 

6.3 We may still be liable for:

 

(a)death or personal injury arising from our negligence;

 

(b) fraudulent misrepresentation; and

 

(c) any other liability which cannot be excluded or limited under applicable law.

 

7.Governing Law:

7.1 The terms and conditions are governed by and construed in accordance with the laws of England and Wales.

 

7.2 In the event of any dispute/claim arising out of the contract (including non-contractual disputes/claims), each party agrees that the courts of England and Wales shall have exclusive jurisdiction.

 

8.Personal Information:

 

All information provided by you is treated as confidential and in line with the JS Tutoring privacy policy as stated on our website.

 

Plagiarism, copying, sharing or distribution in part or whole of any of JS Tutoring’s Course materials is strictly prohibited. We will act against any individual or company found to be flouting these rules.
